These Terms and Conditions set out the basis on which Waste Collection Lewisham provides waste collection and related services to residential and commercial customers. By booking a collection or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any waste or rubbish collection, removal, transportation, clearance, or related service provided by us within our service area.

1.2 Customer, you or your means the person, business, company, organisation or other entity requesting or receiving the Service.

1.3 We, us or our means the waste collection service provider operating under the name Waste Collection Lewisham.

1.4 Booking means a confirmed request for the Service made by the Customer via telephone, email, online form or any other agreed method.

1.5 Waste means any materials presented for collection, including household waste, commercial waste, bulky items and other refuse, excluding materials specifically prohibited under these Terms and Conditions or under applicable law.

1.6 Contract means the binding agreement between you and us for the provision of the Service, comprising these Terms and Conditions and the details of your Booking as confirmed by us.

2. Scope of Service

2.1 We provide waste collection and related services within our operating area, which includes Lewisham and nearby locations, as specified by us from time to time.

2.2 The specific nature of the Service, including the type and volume of waste to be collected, access details, timing and any additional requirements, will be agreed at the time of Booking.

2.3 We reserve the right to refuse any waste that we reasonably believe is hazardous, illegal, improperly packaged, contaminated, or outside the scope of the agreed Service.

2.4 We may use our own vehicles and personnel or engage subcontractors to perform the Service. In all cases, these Terms and Conditions shall apply.

3. Booking Process

(a) your name and contact details;

(b) the collection address and any access instructions;

(c) the type, approximate quantity and nature of the waste;

(d) preferred dates and times for collection; and

(e) any other relevant information requested by us.

3.2 A Booking is not confirmed until we have accepted it and provided you with a confirmation, which may be given verbally, in writing or electronically. Once confirmed, a Contract is formed between you and us.

3.3 We reserve the right to decline any Booking at our absolute discretion, including where we believe the waste cannot be handled safely or lawfully, or where the address lies outside our normal service area.

3.4 You are responsible for ensuring that all details of your Booking are correct. If you need to amend your Booking, you must notify us as soon as possible. Changes may be subject to availability and additional charges.

4. Access and Customer Responsibilities

4.1 You must ensure that our personnel have safe and unobstructed access to the collection point at the agreed time. This includes arranging parking permissions, gate codes, security clearances, or any other access provisions needed.

4.2 Waste must be presented in a manner that is safe for manual handling and transportation, including suitable bags, containers or bundles where appropriate.

4.3 You must segregate or identify any waste that is subject to special handling requirements under applicable waste regulations, including electrical items, clinical waste, sharps, chemicals or other controlled materials.

4.4 If we are unable to access the collection point or find that the waste presented differs significantly from the description given at the time of Booking, we may cancel the visit, adjust the Service, or apply additional charges to reflect the extra time, labour, or resources required.

5. Pricing and Payments

5.1 The price for the Service will normally be provided to you at the time of Booking, based on the information you provide about the waste and access conditions.

5.2 Prices are usually quoted inclusive of labour, transport and standard disposal fees, unless otherwise stated. Additional charges may apply for certain types of waste, excessive weight or volume, or difficult access.

5.3 We reserve the right to revise the quoted price if, upon arrival, we find that the waste volume, type, or access conditions are materially different from those described at the time of Booking.

5.4 Unless otherwise agreed, payment is due on or before completion of the Service. We may accept cash, card payments, bank transfer, or other methods as notified to you. Businesses may be offered account terms subject to prior approval.

5.5 Where account terms are agreed, invoices are payable within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

5.6 If you fail to make payment when due, we may:

(a) charge interest on the overdue amount at the statutory rate permitted under UK law; and

(b) suspend or cancel further Services until all outstanding sums are paid in full.

6. Cancellations and Rescheduling

6.1 You may cancel or reschedule your Booking by notifying us in advance. The following conditions apply unless otherwise agreed:

(a) If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

(b) If you cancel within 24 hours of the scheduled collection time, we may charge a cancellation fee to cover our administrative and scheduling costs.

(c) If we attend the collection address at the agreed time and are unable to complete the Service due to access issues or other circumstances within your control, we may charge a call-out fee and any related costs.

6.2 Any request to reschedule a Booking is subject to our availability. We will use reasonable efforts to accommodate changes but cannot guarantee specific dates or times.

6.3 We may cancel or postpone the Service if:

(a) weather or road conditions make it unsafe to operate;

(b) we experience vehicle breakdowns or staff shortages;

(c) we reasonably believe the waste cannot be collected or transported safely or lawfully; or

(d) any other event occurs that is beyond our reasonable control.

6.4 In such cases, we will notify you as soon as reasonably practicable and, where possible, offer an alternative time for the Service. We will not be liable for any losses arising from such cancellations or delays, subject to clause 9.

7. Waste Regulations and Prohibited Materials

7.1 We operate in accordance with applicable UK waste management legislation and regulatory requirements. By using our Service, you agree to cooperate with us in ensuring compliance.

7.2 You warrant that all waste presented for collection is your property or that you have the necessary authority to dispose of it.

7.3 You must not present any waste for collection that is illegal, hazardous, explosive, radioactive, or otherwise prohibited by law or guidance issued by regulatory authorities.

7.4 Prohibited or restricted materials may include, but are not limited to, asbestos, certain chemicals, fuels, solvents, medical or clinical waste, pressurised containers, ammunition, and contaminated items. If you are unsure whether particular waste can be collected, you must ask us in advance.

7.5 If we discover prohibited waste during collection or after removal, we may:

(a) refuse to collect it or isolate it from other waste;

(b) return such items to you; and

(c) charge you for any additional handling, treatment, or disposal costs we incur, as well as any regulatory fines or penalties arising from your failure to comply with waste regulations.

7.6 Once collected, waste becomes our responsibility and will be transported and processed at licensed facilities in line with applicable legislation. We aim to maximise recycling and recovery where reasonably practicable.

8. Customer Warranties and Indemnities

8.1 You warrant that all information you provide to us in connection with the Service is true, complete and not misleading in any material respect.

8.2 You are responsible for obtaining any permissions, permits or consents required for us to access the collection address and to remove the waste.

8.3 You agree to indemnify us against all claims, losses, damages, costs and expenses arising from:

(a) your breach of these Terms and Conditions;

(b) your failure to comply with applicable waste regulations; or

(c) any third-party claim that our removal of the waste was unauthorised.

9. Liability and Limitations

9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be limited or excluded by law.

9.2 Subject to clause 9.1, we shall not be liable for:

(a) any loss of profits, revenue, business, goodwill or anticipated savings; or

(b) any indirect or consequential loss or damage, whether arising in contract, tort, negligence, misrepresentation, or otherwise.

9.3 Our total aggregate liability to you for all claims arising out of or in connection with the Service shall not exceed the total fees paid or payable by you for the specific Booking giving rise to the claim.

9.4 You are responsible for removing or securing any items you wish to retain. We accept no liability for items taken away as waste where those items were reasonably presented for collection.

9.5 While we take reasonable care when carrying out the Service, we are not liable for unavoidable minor damage to driveways, paths, surfaces or surroundings arising from the normal operation of vehicles or manual handling in the course of the Service.

10. Complaints and Disputes

10.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible, providing details of the issue.

10.2 We will investigate complaints promptly and aim to resolve them in a fair and reasonable manner. We may request further information, site photographs or other evidence where relevant.

10.3 If we are unable to resolve a dispute informally, either party may pursue legal remedies in accordance with clause 13.

11. Data Protection and Privacy

11.1 We collect and process personal data in connection with the Service, including contact details, service addresses, and payment information.

11.2 We will use your personal data only for legitimate business purposes, including managing Bookings, providing the Service, processing payments, handling complaints, and meeting our legal obligations.

11.3 We will take appropriate technical and organisational measures to protect your data and will only retain it for as long as reasonably necessary for the purposes described above or as required by law.

12. Changes to These Terms and Conditions

12.1 We may update or revise these Terms and Conditions from time to time. The version in force at the time of your Booking will apply to that Booking.

12.2 Where changes are required by law or regulation, they may apply immediately to existing Contracts, and we will notify you where reasonably practicable.

13. Governing Law and Jurisdiction

13.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

14. General Provisions

14.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

14.2 No failure or delay by us to exercise any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

14.3 You may not assign or transfer your rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations, provided that this does not materially affect the Service.

14.4 These Terms and Conditions, together with the details of your Booking as confirmed by us, constitute the entire agreement between you and us in relation to the Service and supersede any prior discussions or understandings.
